    Gero Marilia - Marilia Buildings has been fighting a legal battle and seeking compensation for the sand court works.

    A dispute between residents against a gated residential complex in eastern Marilia has reached the courts after a couple cited numerous inconveniences due to the construction of a sand court next to their residence.
    They want urgent action against the use of the space, and ultimately compensation for the moral damage caused by the work.
    The application was filed against the owners association of the residential complex, in the development corridor of this model of Avenida da Esmeraldas.


    Residents' complaint is that the court's implementation has caused loss of privacy and disruption of peace.

    They also say that the implementation of the new area is contrary to the project that was approved when the compound was implemented.

    They were unable to obtain an injunction against the space, but the court asked the condominiums for information.

    “Although the complainants' allegations are relevant, they are undoubtedly not sufficient to describe the real urgent situation that justifies the approval of this measure on this occasion, without the prior hearing of the opposing party. “There is the possibility of waiting for the summons and exercising the defense without constituting a real obstacle to the effectiveness of judicial protection,” stated a decision issued by the Second Civil Court of Marilia.

    The residential complex will have 15 days to file a statement regarding the work and the nuisance charges.
