    Amends Bill 105/22 Health Plans Act To include specific rules about the care that private health plans provide for people with disabilities or rare diseases.

    The proposal was submitted to the House of Representatives by the deputy Joao Daniel (PT-SE).

    “In the context of complementary health, it is not uncommon for people with disabilities and rare diseases to be denied basic procedures, on the grounds that current law does not support a particular type of coverage. However, when it comes to individuals with this type of health impairment, The enjoyment of consultations or procedures is essential to their well-being.”Parliamentary justifies.

    current law

    Today, according to current law, no one can be prevented from participating in private health plans because of a disability.

    João Daniel’s proposal goes further by emphasizing that plan operators must ensure comprehensive and adequate care for people with disabilities and people with rare diseases, and not be able to impose any undue restrictions on them.

    The text defines comprehensive and adequate care as being in full compliance with the request of the assistant physician, who determines the best therapeutic intervention or treatment for the patient, provided that the necessary inputs are recorded by the National Health Surveillance Agency (Anvisa) and the procedures are recognized by the relevant authorities.

    The proposed procedure does not include the search for or supply of medicines for home treatment, except as provided.

    Operators who do not provide coverage for the multiple professional care provided for in the project may have to reimburse in full with non-certified professionals.

    According to the text, multidisciplinary care for people with disabilities and people with rare diseases includes the help of trained professionals who specialize in the indicated areas; and coverage of unlimited sessions with health professionals designated by the attending physician, such as psychologists and speech therapists.

    It will be up to the National Agency for Complementary Health (ANS) and consumer protection agencies to monitor and investigate complaints about non-compliance with applicable rules.

    An operator that fails to comply with the rules will be subject to a fine and revocation of the operating license, among other penalties. The amounts resulting from the collection of fines will be used to train, train and improve working conditions for professionals who work with people with disabilities and people with rare diseases in the Unified Health System (SUS).

    Procedure

    The project is being finalized and will be analyzed by the Committees for the Defense of the Rights of Persons with Disabilities; social security and family; Constitution, justice and citizenship.
