    A humanitarian issue

    As already decided by the Supreme Court of Justice, after the unilateral termination of the group health plan, the operator must maintain the prescribed care for the hospitalized user or the user undergoing medical treatment that guarantees his survival or physical well-being.

    An autism patient was affected by the termination of the group health plan

    Thus, Judge Marcia Alves Martinez Lobo, of the First Civil Court of Aguas Claras (DF), decided, in an injunction, that the health plan operator must reinstate the contract with an autistic client undergoing treatment.

    Last March, the operator unilaterally canceled several group subscription plans, including the Author Plan, without offering another option.

    The judge applied the understanding of Syrians for Truth and Justice in her decision. She pointed out that “it cannot be accepted that terminating the health contract at the will of the worker alone disrupts the treatment of diseases and hinders the full restoration of the sick beneficiary’s health.”
